Terms of Service

1. Acceptance of Terms

By downloading, creating an account, accessing, or using the PickleFlex mobile applications (iOS and Android) and related services (collectively, the “App”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you may not access or use the App.

2. User Accounts and Eligibility

You must be at least 13 years of age to use the App. By registering an account, you represent and warrant that all registration information you submit is accurate, current, and complete. You are responsible for safeguarding your login credentials and for all activities that occur under your account.

3. PickleFlex Pro Auto-Renewable Subscriptions

PickleFlex offers an optional premium subscription service known as PickleFlex Pro, which unlocks unlimited match posting and claiming, 24-hour priority early access to new match listings, and official DUPR rated matchmaking and score synchronization.

• Subscription Plans & Pricing: PickleFlex Pro is offered under three auto-renewing subscription options:
  • Pro Monthly: $4.99 per month
  • Pro 6-Month: $24.99 per 6-month period
  • Pro Annual: $44.99 per year
  Prices are displayed in U.S. Dollars (or localized currency equivalents) and are subject to change with advance notice.
• Billing & Payment: Payment is charged to your Apple ID (for iOS users) or Google Play Account (for Android users) upon confirmation of purchase.
• Automatic Renewal: Subscription automatically renews unless auto-renew is disabled at least 24 hours prior to the end of the current billing cycle. Your account will be charged for renewal within 24 hours prior to the conclusion of the current subscription period at the rate of the selected plan.
• Cancellation Anytime: You can manage and cancel your subscription at any time. To cancel on iOS, open your device’s Settings > [Your Apple ID Name] > Subscriptions and select PickleFlex. To cancel on Android, open the Google Play Store > Profile > Payments & Subscriptions. If you cancel, your subscription will remain active until the end of your current paid billing period, after which it will not renew.
• Refunds: All refund requests are handled directly by Apple (via reportaproblem.apple.com) or Google Play in accordance with their respective refund policies. PickleFlex does not directly process subscription refunds.
• Free Match Quota: Users without an active PickleFlex Pro subscription are granted a free quota of up to 3 Flex Play matches (posts and claims combined) per rolling 30-day period. Unused matches do not roll over between periods.

4. Flex Play Self-Organized Matches & Athletic Safety Waiver

PickleFlex provides a technology platform that allows independent players to discover each other, post open game slots, and organize recreational and competitive pickleball sessions at public or private venues.

• Independent Coordination: Except for designated official PickleFlex tournament events, Flex Play matches are arranged independently between users. PickleFlex does not inspect, own, supervise, operate, or maintain any courts, facilities, or equipment. Players are solely responsible for selecting safe court locations and adhering to local park and facility rules.
• Assumption of Risk: You acknowledge that participating in physical sports such as pickleball involves inherent risks of bodily injury, dehydration, sprains, fractures, heat illness, and other hazards. You voluntarily assume full responsibility for all risks associated with your participation in matches organized through the App.
• Injury & Liability Release: To the fullest extent permitted by applicable law, you release, waive, and hold harmless PickleFlex, its officers, directors, employees, and agents from any and all claims, demands, liabilities, damages, or injuries arising out of or related to your participation in matches arranged through the App. You play entirely at your own risk.

5. DUPR Integration & Competitive Integrity

PickleFlex integrates with the Dynamic Universal Pickleball Rating (DUPR) platform. Players participating in DUPR Rated matches agree to:

• Abide by the official rules and scorekeeping standards of USA Pickleball and DUPR.
• Submit authentic, verified scores for matches actually played in full.
• Refrain from entering fraudulent match results, fake opponents, or collusive outcomes to manipulate ratings. Submitting fraudulent scores is a material breach of these Terms and will result in immediate and permanent account termination.

6. In-App Communication & User Conduct (Zero-Tolerance Policy)

PickleFlex provides 1-on-1 match chats and community features to coordinate play. In compliance with Apple and Google standards for user-generated content, we enforce a strict Zero-Tolerance Policy for objectionable content and abusive behavior:

• You may not send messages, upload photos, or post content that is hateful, threatening, sexually explicit, defamatory, harassing, or discriminatory.
• You may not use the App to spam, solicit commercial services, or distribute malware.
• You may not engage in unsportsmanlike conduct, repeated unexcused match no-shows, or intentional court disputes.
• Users can report abusive players directly inside the App or by contacting support. Reported accounts are reviewed promptly, and any user found violating these standards will be subject to content removal and immediate suspension or permanent banning through our Strike System.

7. Account Termination

We reserve the right to suspend, terminate, or delete your account at our sole discretion, without prior notice or liability, if you violate these Terms, engage in fraud or harassment, or compromise the safety of other players.

8. Intellectual Property

All trademarks, logos, interface designs, code, and branding associated with PickleFlex are the exclusive property of PickleFlex. You may not copy, reverse engineer, or reproduce any portion of the App without our express written permission.

9. Disclaimer of Warranties & Limitation of Liability

The App is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. In no event shall PickleFlex be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, loss of data, or interactions with other users.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware and the United States, without regard to conflict of law principles.
